But as your business starts to gain traction, a crucial question almost always pops up in our strategy sessions: Do I need to trademark my logo?

When people think of trademarks, they usually just think of a business name or a logo graphic. But under intellectual property guidelines in Aotearoa, a trademark can cover a surprising variety of distinct identifiers:

If it makes your brand completely unique in the marketplace, it is an asset worth protecting.

Registering your logo as a trade mark gives your business legal protection in distinguishing your brand from competitors. This gives you exclusive rights to the use of that trade mark, identified by a ® symbol.

Without this formal registry, stopping a copycat or a confusingly similar business from opening down the road and diluting your hard work can become a stressful, expensive battle.

As your business grows, your trademark will continue to increase in value, as you become more established in the market and develop brand awareness. Furthermore, businesses with trade marked logos have a greater level of perceived legitimacy with a verified distinct asset. If you ever plan to sell your business, franchise it, or seek major investment down the line, a registered trademark makes your business significantly more secure.
